1. Introduction
This Refund and Cancellation Policy ("Policy") governs all subscription purchases and service engagements made through Finegym LLC ("Finegym", "we", "our", or "us"). Finegym provides a subscription-based gym management SaaS platform used by fitness businesses globally. This policy applies to all users, including gyms, administrators, and staff, who maintain a Finegym subscription.
By purchasing or using our Services, you agree to the terms of this Policy.
2. Subscription Plans
Finegym operates on a monthly or annual subscription model, with pricing tiers based on the number of active gym members.
- Subscriptions are processed through Stripe, and billing recurs automatically unless cancelled in advance.
- Customers can upgrade or downgrade their plans at any time via the admin dashboard.
- Billing adjustments (pro-rata credits or charges) are applied automatically during plan changes.
3. Cancellation Policy
You may cancel your subscription at any time through your account settings.
- Cancellation takes effect at the end of the current billing cycle (monthly or annual).
- No additional charges will be incurred after cancellation.
- You will retain full access to the platform until the conclusion of the current billing term.
3.1. How to Cancel
To cancel, log in to your Finegym admin dashboard and navigate to the billing section. Cancellations must be completed before the renewal date to avoid future charges.
4. Refund Policy
Finegym maintains a strict no-refund policy, except under limited circumstances as described below.
4.1. Non-Refundable Scenarios
We do not offer refunds for:
- Partial use of services;
- Unused time during an active subscription;
- Failure to use or benefit from the platform;
- Subscription downgrades (remaining balance is applied as credit);
- Voluntary cancellations after the billing period begins.
4.2. Eligible Refunds (Exceptional Circumstances Only)
Refunds may be granted in exceptional cases where:
- A verified, recurring technical issue renders the service unusable;
- The issue has been reported within 14 days of the billing date;
- Our technical team confirms inability to resolve the issue within a reasonable timeframe.
Refunds in such cases are at Finegym’s sole discretion and may be issued as a partial or full refund, depending on severity and downtime impact.
5. Free Trials
If your subscription begins with a free trial period:
- You may cancel at any time during the trial without incurring charges;
- If not canceled, the subscription will convert automatically to a paid plan at the end of the trial period.
We do not issue refunds for charges incurred after the trial if cancellation was not completed in time.
6. Downgrades and Pro-rata Credits
When a customer downgrades to a lower plan tier:
- The unused portion of the previously paid subscription is automatically credited toward future billing;
- Credits are applied at the next renewal or immediately if upgrading/downgrading again;
- Credits are non-refundable and non-transferable.
7. Termination by Finegym
Finegym reserves the right to suspend or terminate your subscription and access to Services if:
- You violate the Terms of Service;
- You engage in abusive or fraudulent behavior;
- Payment fails and is not resolved within a reasonable grace period.
In such cases, no refund will be provided unless required by law.
